Terms of Service

1. Eligibility

• You must be at least 18 years old.
• The service is not intended for residents of the European Union.
• You may use the service only in compliance with applicable laws.

2. Accounts and Security

Authentication is provided via Supabase and Google. You are responsible for maintaining the security of your account and for all activity under it. We may suspend or terminate accounts that violate these terms or applicable law.

3. Acceptable Use

• Do not interfere with, disrupt, or attempt to gain unauthorized access to the service.
• Do not upload unlawful, harmful, or infringing content.
• Do not use the service to violate privacy, publicity, or other rights of third parties.

4. Data Contributors and Licensing

If you submit first-person video or image data, you agree to the Contributor Agreement. You grant us a worldwide, irrevocable, perpetual, royalty-free, transferable license to use, reproduce, distribute, create derivative works from, and otherwise exploit submitted data for research, development, commercial use, and model training. You represent that you have the rights and permissions necessary to grant this license and that your submissions do not infringe others' rights.

5. Payments

Any compensation to contributors is handled through the channels we specify. You are responsible for any taxes or fees associated with payments you receive.

6. Data Practices

Data you submit may be combined with other datasets and irreversibly incorporated into trained models and derivative outputs. Deleting your account may not delete data already used for research, training, or derived artifacts. Additional details are in our Privacy Policy and Contributor Agreement.

7. Intellectual Property

We own the service, including all associated intellectual property. Except as expressly allowed by these terms, you may not copy, modify, distribute, sell, or lease any part of the service. You retain ownership of content you submit, subject to the licenses granted above.

8. Disclaimers

The service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, Embodiment AI will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or use, even if advised of the possibility. Our total liability for any claim arising out of or relating to the service will not exceed the amounts you paid to us (if any) for the service in the twelve months preceding the claim.

10. Termination

We may suspend or terminate access at any time for violation of these terms, to comply with law, or to protect the service. You may stop using the service at any time. Sections intended to survive termination (including licensing, disclaimers, and limitations of liability) will remain in effect.

11. Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.
